The "Protected" part refers to "protected under HIPAA law". The "Health Information" part refers to peoples' personal and confidential medical records. HIPAA defines PHI rather precisely. Under HIPAA law (Section 164.501 "Definitions"), PHI is a subset of "Individually Identifiable Health Information" ("IIHI"). <br> This is defined as: ---- "Individually identifiable health information is information that is a subset of health information, including demographic information collected from an individual, and: * Is created or received by a health care provider, health plan, employer, or health care clearinghouse; and * Relates to the past, present, or future physical or mental health or condition of an individual; the provision of health care to an individual; or the past, present, or future payment for the provision of health care to an individual; and, *That identifies the individual; or, *With respect to which there is a reasonable basis to believe the information can be used to identify the individual." ---- To meet the strict definition of "PHI", the information must further be: ---- "Transmitted by electronic media; * Maintained in any medium described in the definition of electronic media at § 162.103 of this subchapter; or Transmitted or maintained in any other form or medium." ---- In more practical terms, PHI generally refers to virtually all personal medical records, including billing records for healthcare services. PHI may be in any medium (paper, film, computer disks, tape recordings, etc.), including even spoken conversations in some circumstances. HIPAA makes it a crime to knowingly or willfully access, use or transmit PHI without valid authority to do so.
